Terms for Adding Your Fidelity Bank Check Card to Samsung PayTM

These Terms apply when you add a Fidelity Bank Check Card to the Samsung Pay mobile payments solution. In these Terms, 'You' refers to the cardholder, and 'We' refers to Fidelity Bank. When you add your Fidelity Bank Check Card to Samsung Pay, you agree to these supplementary Terms.
 

1. Adding Your Fidelity Bank Check Card

You can add your Fidelity Bank Check Card to Samsung Pay by following the instructions on http://www.samsung.com/us/samsung-pay. If your Fidelity Bank Check Card or underlying account is not in good standing, You will not be eligible to enroll in Samsung Pay. When you add a Fidelity Bank Check Card to Samsung Pay, you are allowed to use your Fidelity Bank Check Card to enter into transactions where Samsung Pay is accepted. Samsung Pay may not be accepted at all places where your Fidelity Bank Check Card is accepted.

2. Your Fidelity Bank Check Card Terms Do Not Change

The terms and account agreement that govern your Fidelity Bank Check Card do not change when you add your Fidelity Bank Check Card to Samsung Pay. Samsung Pay simply provides another way for you to make purchases with your Fidelity Bank Check Card. Any interest, fees, and charges applicable to your Fidelity Bank Check Card will also apply when you use Samsung Pay to access your Fidelity Bank Check Card. Fidelity Bank does not charge you any additional fees for adding your Fidelity Bank Check Card to Samsung Pay or using your Fidelity Bank Check Card in Samsung Pay. Samsung Pay and other third parties such as wireless companies or data service providers may charge you fees.

3. Fidelity Bank Is Not Responsible for Samsung Pay

We are not the provider of Samsung Pay, and we are not responsible for providing Samsung Pay service to you. We are only responsible for supplying information securely to the Samsung Pay provider to allow usage of the Fidelity Bank Check Card in Samsung Pay. We are not responsible for any failure of Samsung Pay, or the inability to use Samsung Pay for any transaction. We are not responsible for the performance or non- performance of Samsung Pay or any other third parties regarding any agreement you enter into with Samsung Pay or associated third party relationships that may impact your use of Samsung Pay.

4. Governing Law and Disputes

Federal law governs these Terms and, to the extent that state law applies, the laws of the state under which your Fidelity Bank Check Card is covered may apply to these Terms. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures in your Fidelity Bank Account Agreement and Disclosures.

5. Ending or Changing these Terms; Assignments

We can terminate these Terms at any time. We can also change these Terms, or add or delete any items in these Terms, at any time. We will provide notice if required by law. You cannot change these terms, but you can terminate these Terms at any time by removing your Fidelity Bank Check Card from Samsung Pay. These Terms shall remain applicable if we assign our rights regarding use of the Fidelity Bank Check Card in whole or part, including access to Samsung Pay. Your rights to use of the Fidelity Bank Check Card are not assignable.

6. Privacy

Your privacy and the security of your information are important to us. Our Consumer Privacy Notice (https://www.lionbank.com/privacy-policy) applies to your use of your Fidelity Bank Check Card in Samsung Pay. By adding Samsung Pay, You agree that we may share your information with Samsung Pay, a payment network, and others in order to provide the services you have requested, to make information available to you about your Fidelity Bank Check Card transactions, and to improve our ability to offer these services. This information helps us to add your Fidelity Bank Check Card to Samsung Pay.

7. Notices

We can provide notices to you concerning these Terms and your use of your Fidelity Bank Check Card in Samsung Pay by posting the material on our website, through electronic notice given to any email address or telephone number you provide to us, or by contacting you at the current address we have on file for you.
